Babbage Privacy Statement

At Babbage, we handle personal data with care. Whether you are a candidate or a contact person at a client, we believe it is important that you know what data we use, why we do so, and what rights you have.

We process personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy legislation. In this privacy statement, we explain this clearly and transparently.

1. Who are we?

Babbage ensures that communication works. We broker professionals in marketing, communication, and content, and execute content and communication assignments. We are responsible for the processing of personal data as described in this privacy statement.

2. To whom does this privacy statement apply?

This privacy statement applies to candidates (such as job applicants, professionals we place on assignments, seconded employees, and freelancers) and to contact persons at clients and other business relations.

3. What personal data do we process?

You are a candidate in an open call or application procedure :

  • name, address and place of residence
  • email address and telephone number
  • CV details, education and work experience
  • motivation and availability
  • meeting minutes and relevant notes.

You are a candidate we are placing on a (temporary) assignment:

  • above information, and:
  • data for processing a placement, contracts, secondment or administration
  • payment details (such as IBAN)
  • for self-employed professionals: Chamber of Commerce and VAT number
  • identity details (such as a copy of your proof of identity)
  • diplomas, certificates or other supporting documents
  • a Certificate of Conduct (VOG)

We only collect data from candidates that is necessary for our services or for assessing whether a candidate meets the requirements of a client or the law.

You are the contact person at a client or other business relationship :

  • name, position and company name
  • business email address and phone number
  • address and billing details
  • communication and agreements required for contracts and cooperation.

4. What do we use personal data for?

We use personal data to mediate permanent or temporary positions and assignments for you, to maintain contact, to manage application procedures, to execute contracts or assignments, to comply with legal obligations, and to inform you about relevant vacancies or activities.

5. On what grounds do we process this data

We process personal data because this is necessary for our services as a recruitment agency. We do this on the basis of one or more of the following legal grounds: the performance of a contract, a legitimate interest, your consent, or a legal obligation.

6. Newsletters and automated email communication

When you register with Babbage or respond to a vacancy, you indicate that you are looking for a new position or assignment through Babbage. To inform you about this, we may send you personalized newsletters or other automated email communications.

In this way, we can also inform contact persons at clients about our services and relevant developments.

Every newsletter or other automated email contains an unsubscribe link. Candidates and contacts can unsubscribe at any time via this link.

Unsubscribing from newsletters or automated email communications does not mean that your personal data will be automatically deleted by Babbage. You can submit a separate request for this via info@babbage.nl.

7. With whom do we share personal data?

We only share personal data if this is necessary for our services, for the performance of an agreement, or to comply with a legal obligation.

Your data may be shared with clients, for example, when a candidate is proposed or is in the process, and only to the extent necessary. This always takes place within the context of mediation or placement.

In addition, we make use of external parties that support us in our activities, such as IT and software suppliers, administrative service providers, or other parties we engage for our business operations. These parties process personal data exclusively on our behalf.

We make agreements with all parties that process personal data for us regarding confidentiality, security, and the proper handling of data.

We do not sell personal data to third parties and never provide it to others for commercial purposes.

8. How long do we retain personal data?

We apply different retention periods for candidates, depending on the situation.

When you apply, we ask you whether we may retain your data for at least one year. If you choose not to, we will retain your data for four weeks after an open registration or the completion of an application procedure. Within that period, you will receive an email in which you can indicate that we may not retain your data after these four weeks. If you do not indicate this, we will retain your data for a maximum of one year.

Four weeks before this one-year retention period expires, you will receive another email with the same option. You will receive this reminder annually thereafter, so that your data remains in our database.

When we place you on an assignment, we are legally required to retain data relating to that placement for seven years. You can still have other data not relevant to the placement removed via the annual reminder email.

For contact persons at clients and other business relations, we retain business data for as long as the collaboration continues and as long as we have a legitimate interest in maintaining contact. If there has been no contact for five years, we delete this data.

You can ask us to delete your data at any time via info@babbage.nl. As long as there is no legal obligation to retain data, we will always comply with this request. We will always confirm the deletion via email within one month.

9. How do we protect personal data?

We take appropriate technical and organizational measures to protect personal data against loss, misuse, and unauthorized access.

This means, among other things, that:

  • Only employees who need this data for their work get access.
  • systems and accounts are secured with appropriate measures
  • we handle the storage and processing of personal data with care.

In addition, we collaborate with suppliers who support us in our services, such as software and IT service providers. We make clear agreements with these parties regarding security, confidentiality, and the use of personal data.

We set requirements for our suppliers and regularly check whether they adhere to these agreements.

10. Your rights regarding your data

You have the right to access, modify, or delete your personal data. You can also object to the use of your data, withdraw your consent, or request that your data be transferred.

If you wish to exercise one of these rights, you can contact us via info@babbage.nl. We will always confirm the execution of your request by email within one month.
